INSURANCE COMPANIES AND INSURANCE ADJUSTERS FAIL AND REFUSE
TO PROPERLY PAY INSURANCE CLAIMS IN THE STATE OF CALIFORNIA
(UNINSURED MOTORIST CLAIMS, EARTHQUAKE, AFTERSHOCK, FIRE, FLOOD, SMOKE, BUSINESS INTERRUPTION)

We all want to trust and believe in the inherent goodness of humanity and in the sanctity of the relationship between an insurance policyholder and an insurance company. We purchase insurance policies and pay our premiums to buy security for our families, to buy peace of mind, and to quell our fears about the extreme financial consequences of accidents and natural disasters. Simply stated, we want and need proper insurance protection in the event of an insured loss or natural disaster. Therefore, as first-party insureds, we have reasonable expectations that the insurance companies will be there to take us into their collective hands and pay for all of our insured losses in the event of a tragedy. After all, insurance companies have a contractual obligation to their policyholders and they owe their policyholders a duty of good faith fair dealing. Notwithstanding the same, insurance companies and their adjusters routinely fail and refuse to properly and timely pay first-party insurance claims in the State of California.

The insurance companies and their adjusters may attempt to justify their positions by telling policyholders that the damages do not exceed the insurance deductibles or that the insurance policy does not cover the damages reported. The insurance companies may even suggest that the damages were not caused by an insured event. The insurance companies also deny claims outright on the basis that the statute of limitations had allegedly expired. Moreover, the insurance companies are notorious for hiring unqualified examiners, adjuster and estimators to underestimate the full and complete nature, extent and scope of the damages which were actually sustained by an insurance policyholder in connection with their first-party insurance claims. The insurance companies have also been known to spend huge sums of money to retain alleged experts in an attempt to show that your damages were not really caused by an insured event.

Therefore, an insurance policyholder should not simply operate under the mistaken belief that their insurance company will always just do the "right thing" and fully compensate them for any and all covered losses. The clear fact of the matter is that insurance companies and their representatives are not always there to protect the rights and interests of an insurance policyholder. They are sometimes there only to protect their own rights and interests, as well as to protect their own bottom line. We are there only to protect the rights and interest of our clients. We can be there to protect your rights and interests as an insurance claimant if we agree to handle your case or matter.

Under any circumstances, please follow these simple guidelines if you sustain insured property, earthquake property damages, personal injuries or related losses. First and foremost, secure your person and property and then report your uninsured motorist claims, earthquake, fire or flood claim to your own insurance carrier, even if your property is located in a declared disaster area. Once your insurance claim is reported, immediately contact the Los Angeles Insurance Bad Faith Lawyers and California Insurance Bad Faith Attorneys at the Rosenstein Law Offices to properly handle all of your insurance claims and/or cases from start to finish. We may even be willing to handle your claims on a contingency fee basis.

CALIFORNIA INSURANCE BAD FAITH COMPLAINTS AGAINST CALIFORNIA
INSURERS ( CDI PROVIDES INFORMATION TO THE PUBLIC)

For more information about complaints against in insurance companies in the State of California, the California Department of Insurance (CDI) publishes a Consumer Complaint Study (CCS) that provides information about consumer complaints against insurance companies pursuant to §§1292.1 of the California Insurance Code.

The Consumer Complaint Study of the CDI is comprised of two different studies with informational data about insurance companies. The CDI study also categorizes the data of insurance companies based on the type of insurance they sell or provide (Automobile, Homeowners, and Life). The CDI study categories the information as follows:

The tables in the CDI study provide information about an insurance company's rank, company name, approximate number of insurance policies and related exposures in California, ratio of complaints and actual number of justified complaints for the past several years. The California Department of Insurance then ranks insurers according to their justified complaint ratio. According to the CDI, the justified complaint ratio in the CCS study is based on the number of justified complaints per 100,000 policies or exposures. If an insurance company does not have a ratio, the CDC ranks the company by the policy or exposure count.

The California Department of Insurance (CDI) also provides an Insurance Company Performance table with alleged violations for specific calendar years. This table shows the complaints against companies which have determined by the CDI to require corrective action against the insurer, leading to insurer compromise or other remedy against insurer, those that are found to be without merit, those with other outcomes, and justified complaints.
